The Waivy Baby Full Legal Suite
This Legal & Compliance Center is the umbrella document that houses all supplemental policies for Waivy Baby LLC. It works alongside and is incorporated into our standalone legal documents. Together, these documents form the complete agreement between you and Waivy Baby.
In the event of any conflict between this Legal & Compliance Center and any standalone policy document, the standalone document controls for that subject matter. All documents are governed by the laws of the State of New York with exclusive jurisdiction in New York County courts.
- Order Acceptance: Placing an order does not constitute a binding contract until Waivy Baby sends an order confirmation email. We reserve the right to refuse, cancel, or limit any order at our sole discretion — including for pricing errors, suspected fraud, availability issues, or policy violations — with a full refund to the original payment method where applicable.
- Payment Authorization: By completing a purchase, you authorize Waivy Baby and our payment processors to charge your provided payment method for the full order amount including applicable taxes, shipping, and any add-ons. For subscriptions, you authorize recurring charges at the disclosed interval until cancelled.
- Pricing: All prices are listed in USD. Prices are subject to change without notice except as disclosed for active subscription renewals (where 30 days' notice is provided). Display of a price does not guarantee availability at that price.
- Product Descriptions & Substitutions: We strive for accuracy but do not warrant that product descriptions, images, or box contents are complete or error-free. Box contents may vary due to supply constraints. Substitutions will be of equal or greater value and do not constitute a breach of your order or membership agreement.
- Taxes: You are responsible for all applicable taxes, which are calculated and displayed at checkout based on your shipping address and applicable law.
- Gift Cards & Promotions: Promotional codes and gift cards are subject to their stated terms, are non-transferable, and have no cash value unless required by law. Waivy Baby reserves the right to cancel promotions at any time for abuse or error.
- Auto-Renewal: All memberships (Basic, Pro, Elite) auto-renew at the end of each billing period unless cancelled at least 48 hours before renewal. You will be charged the then-current rate.
- Failed Payments: If a payment fails, we may retry the charge, suspend membership benefits, and/or terminate the membership. You remain liable for all outstanding amounts.
- No Prorated Refunds: Membership fees are not prorated for cancellations mid-period except where required by law. Cancellation takes effect at the end of the current paid period.
- Price Changes: We will provide at least 30 days' notice of subscription price changes. Continued use after the effective date constitutes acceptance.
- Chargeback Policy: Initiating an unauthorized chargeback is a material breach. You must contact legal@waivybaby.com before disputing any charge. Unauthorized chargebacks result in account termination and liability for chargeback fees and collection costs.
All Waivy Baby experts, coaches, sleep consultants, feeding specialists, and support staff are independent contractors, not employees of Waivy Baby LLC. They provide educational and informational support only — not clinical care, not medical advice, and not a regulated professional service in your jurisdiction.

- Evidence-informed frameworks and right-time guidance
- Coaching-style encouragement and parenting education
- Group seminar content and community moderation
- Curated resources, templates, and guides
- Medical diagnoses or treatment plans
- Clinical therapy, counseling, or psychotherapy
- Individualized nutritional or lactation prescriptions
- Emergency or urgent medical guidance
- Licensed professional services in your state
- No Employment Relationship: Experts are independent contractors with their own professional obligations. Waivy Baby does not direct or control the expert's clinical judgment.
- No Personal Liability: Per our Master Legal Disclaimer, members waive all claims against individual experts for guidance provided through the platform. Claims must be directed to Waivy Baby LLC.
- Credential Transparency: Experts accurately represent their qualifications. Credentials are not a license to practice in your jurisdiction unless separately verified by you.
- No Outside Solicitation: Experts may not solicit members for services outside the Waivy Baby platform. If an expert contacts you directly for private business, report it immediately to legal@waivybaby.com.
- Platform Communications Only: All expert-member communication must occur through official Waivy Baby channels. No personal contact information exchange is permitted.
Waivy Baby's Support Services — including portal chat, email, messaging, and seminars — are NOT emergency services, are NOT a crisis hotline, and are NOT monitored 24/7.
- If you believe your child is in distress or a life-threatening emergency is occurring, call 911 immediately (or your local emergency number). Do not message the Care Team.
- Do not use Support Services to seek help for urgent or time-sensitive medical concerns.
- Do not delay seeking in-person professional care because of information received through our Concierge or Care Team.
- For urgent medical concerns, contact your pediatrician directly or go to the nearest emergency room.
All guidance from the Waivy Baby Care Team — including concierge staff, moderators, sleep consultants, feeding specialists, and any expert participants through portal chat, email, or seminars — is provided for educational and informational purposes only.
- "Expert-backed guidance" means general education, coaching-style support, and evidence-informed information shared based on the limited information you choose to provide. It is not a diagnosis, treatment plan, prescription, medical clearance, or individualized clinical determination.
- No Guarantees: We make no guarantees regarding outcomes including sleep duration, feeding success, or developmental timelines.
- Response Times: Support Services are not available 24/7. We do not guarantee response times, immediate availability, or continuous access. Response times may vary due to volume, hours of operation, and technical issues.
- As-Is Communications: Concierge responses are provided "as-is" based solely on the information you provide. Waivy Baby is not responsible for outcomes resulting from incomplete or inaccurate information you provide, or from your interpretation or implementation of any message.
- No Professional Relationship: Using Support Services does not create a doctor-patient, therapist-client, attorney-client, or any other professional-client relationship. Waivy Baby is not your agent, fiduciary, or representative.
- The Concierge may recommend specific products from Waivy Baby boxes or third-party vendors. While we curate these items with care, the use of any baby product carries inherent risks.
- You agree to follow all manufacturer safety guidelines, age-appropriateness warnings, and assembly instructions for any recommended product.
- Waivy Baby is not liable for product defects, injuries, allergic reactions, or any harm resulting from the use of recommended items — whether from our own boxes or third-party vendors.
- Recommendations are general suggestions based on milestone stage — they are not personalized medical prescriptions and do not account for your child's specific health conditions.
- All communications through Support Services may be stored for quality assurance, training, legal protection, and dispute resolution per our Privacy Policy.
- Waivy Baby cannot guarantee 100% security of digital transmissions. Standard internet, device, and network risks apply. You share personal information through digital channels at your own risk.
- Waivy Baby is not responsible for damages arising from unauthorized access to communications transmitted through third-party or public networks outside our reasonable control.
- Do not share sensitive medical, financial, or identifying information through Support Service channels unless strictly necessary for the service requested.
Waivy Baby does not sell your personal information to third parties — ever. We only share data as necessary to deliver our services. Your family's privacy is treated with "Fortune 500 level" data handling protocols.
- Personal Identification: Name, email address, shipping address, billing address, and phone number.
- Family & Milestone Data: Your baby's expected or actual birth date, developmental milestones, and feeding or sleep preferences — used to time milestone boxes and personalize expert guidance.
- Payment Information: Processed through secure, PCI-compliant third-party gateways. We do not store full credit card numbers on our internal servers.
- Membership & Interaction Data: Premium membership tier, seminar attendance, class participation, concierge interaction history, and communications with experts and staff.
- Technical Data: IP addresses, browser types, device information, cookies, and usage metrics used to improve our platform and your experience.
- Beta & Analytics Data: During the Beta Phase, additional usage metrics, click/tap data, feature usage, session duration, and crash/performance data are collected to improve the platform. See Section 10 for full Beta data disclosures.
- Shipping & Logistics Partners: Name, shipping address, email, phone, order contents, and shipping preferences — shared with fulfillment warehouses, shipping carriers, and logistics software to deliver your boxes.
- Payment Processors (e.g., Stripe): Name, billing address, payment method details, and transaction identifiers — shared to process payments and prevent fraud. We do not store full card numbers.
- Scheduling & Booking Tools: Name, contact details, appointment details, and intake information — shared with booking service providers to administer confirmations, reminders, and session logistics.
- Expert Consultants (1099 Contractors): Relevant parenting data (sleep/feeding challenges, milestone information) shared on a strict need-to-know basis. Experts are bound by confidentiality obligations.
- Service Providers: Trusted partners for hosting, email delivery, analytics, customer support, and platform operations — contractually obligated to protect your data and use it only for Waivy Baby services.
- Legal Requirements: We may disclose data if required by law, subpoena, court order, or to protect the safety of our community.
- Business Transfers: In the event of merger, acquisition, or asset sale, your data may transfer as a business asset subject to the protections in this policy.
- Access & Updates: Review and update your account information at any time via the member portal.
- Opt-Out of Marketing: Unsubscribe from marketing communications via the link in any email. Transactional emails (order confirmations, membership notices) will continue.
- Data Deletion: Request deletion of your personal data at any time by emailing privacy@waivybaby.com. Deletion is subject to legal retention obligations.
- California Rights: CCPA/CPRA rights including right to know, delete, correct, opt out of sharing, and non-discrimination. See Section 8 for the full California Disclosures.
- Florida Rights: FDBR rights including access, correction, deletion, portability, and opt-out of targeted advertising.
Waivy Baby complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) and responds promptly to valid DMCA takedown notices. We have designated an agent to receive notifications of claimed infringement.

- Safe Harbor: Waivy Baby qualifies for DMCA safe harbor protection for user-generated content posted to our community platforms, provided we act expeditiously upon receiving valid notices.
- Repeat Infringer Policy: Waivy Baby will terminate the accounts of users who are repeat infringers of copyright.
To submit a valid DMCA notice under 17 U.S.C. § 512(c)(3), email legal@waivybaby.com with subject line DMCA Takedown Notice and include:
- Your full name, address, telephone number, and email address;
- A description of the copyrighted work you claim has been infringed;
- The URL or specific location of the allegedly infringing material on our platform;
- A statement that you have a good faith belief the disputed use is not authorized;
- A statement, under penalty of perjury, that the information in your notice is accurate and you are authorized to act on behalf of the copyright owner; and
- Your physical or electronic signature.
Counter-notifications may be submitted by users who believe content was removed in error. Counter-notices must meet the requirements of 17 U.S.C. § 512(g)(3).

Always Sent- CAN-SPAM Compliance: All marketing emails include our physical mailing address, a clear identification as an advertisement where required, and a working unsubscribe mechanism that processes requests within 10 business days.
- Unsubscribe: Click the "unsubscribe" link in any marketing email. You may also email support@waivybaby.com to manage communication preferences.
- No Third-Party Email Sharing: We do not sell, rent, or share your email address with third parties for their own marketing purposes.
- Email Tracking: Marketing emails may include open-tracking pixels. You can disable image loading in your email client to prevent this. See our Cookie Policy for details.
- Not Guaranteed: Joining a waitlist or being an eligible member does not guarantee access to any surprise drop or limited release. Quantities are extremely limited.
- While Supplies Last: All drops are offered while supplies last. Eligibility determination does not constitute a reservation or purchase commitment.
- No Rainchecks or Restocks: Waivy Baby does not guarantee rainchecks, restocks, rain-check credits, or the ability to purchase a drop after it has sold out.
- Substitutions: If a drop includes a physical item and that specific item is unavailable, we may substitute an item of equal or greater value. You accept any substitution by completing your purchase.
- One Per Member / Anti-Abuse: Drops are limited to one per member and one per household. Creating multiple accounts or using others' accounts to access drops is prohibited and results in permanent ban.
- No Resale for Profit: Purchasing a drop for the purpose of reselling, flipping, or listing for profit is a violation of these Terms and results in account termination.
- Active Membership Required: You must have an active, paid membership at the time of eligibility determination to access surprise drops unless expressly stated otherwise.
- Geography & Eligibility: Drops may be geography-limited, tier-limited, or subject to other eligibility criteria stated at the time of the release.
- No Obligation Created: Joining a waitlist does not create a contract, obligation, reservation, or purchase commitment by Waivy Baby.
- Position Not Guaranteed: Waitlist position does not guarantee access. We may fulfill in any order, by random selection, or by membership tier at our sole discretion.
- Cancellation of Waitlist Programs: Waivy Baby may cancel, modify, or discontinue any waitlist or early access program at any time without notice or liability.
- Email Communications: By joining a waitlist, you consent to receive waitlist-related communications. You may unsubscribe from waitlist emails without affecting your account status.

- Right to Know: Request disclosure of the categories and specific pieces of personal information we collect, the sources, and our purposes for collecting it.
- Right to Delete: Request deletion of your personal information, subject to exceptions under California law.
- Right to Correct: Request correction of inaccurate personal information.
- Right to Opt Out of Sale/Sharing: We do not sell personal information for money. However, certain analytics and advertising cookies may constitute "sharing" for cross-context behavioral advertising. Use the "Do Not Sell or Share My Personal Information" link in our Site footer, or email legal@waivybaby.com.
- Right to Limit Sensitive Data Use: Request limitations on the use of sensitive personal information (family/milestone data, precise geolocation) to purposes strictly necessary for service delivery.
- Non-Discrimination: We will not discriminate against you for exercising any CCPA/CPRA right.
- Submitting a Request: Email legal@waivybaby.com. We respond within 45 days (extendable by 45 days with notice). We will verify your identity before processing certain requests.
Waivy Baby curates products from third-party manufacturers for inclusion in our milestone boxes. Our curation process includes:
- CPSC Compliance Review: We select products that are intended to comply with applicable U.S. Consumer Product Safety Commission (CPSC) standards and regulations for infant and toddler products.
- Age-Appropriateness Screening: Products are reviewed for alignment with the developmental milestone stage indicated on the box (0–3 months, 3–6 months, 6–12 months).
- Choking Hazard Review: Products intended for infants are reviewed for small parts and choking hazard concerns per CPSC guidelines.
- Material Safety: We select products intended to be free from BPA, phthalates, and other restricted substances under applicable U.S. standards where material type is relevant.
- Manufacturer Vetting: We evaluate manufacturer reputation, product certifications, and available safety documentation before inclusion.
Important Limitation: Waivy Baby is a curator and distributor — not a manufacturer. We cannot independently verify every claim made by manufacturers, and our vetting process does not constitute a warranty or guarantee of safety. Product liability rests with the original manufacturer.
- You are solely responsible for reading all manufacturer instructions, warnings, and safety guidelines before giving any product to your child.
- Always supervise your child with any product. Never leave a child unattended with toys, teethers, wearables, or any item that could present a hazard.
- Milestone box designations are general guides. You must determine whether a product is appropriate for your specific child's developmental stage, weight, health status, and abilities.
- Check for allergens, especially in textiles, teethers, and feeding accessories.
- If you believe a product in your box is unsafe or defective, stop use immediately and contact support@waivybaby.com. You may also report directly to the CPSC at saferproducts.gov.
- By accepting your box, you acknowledge and assume all risks associated with the use of the products therein, to the maximum extent permitted by law.
- Our services are directed to parents and guardians aged 18 and over. We do not knowingly collect personal information directly from children under 13.
- Any information about a child (birth date, developmental milestones, health preferences) must be provided by a parent or legal guardian.
- If we learn we have inadvertently collected personal information from a child under 13, we will delete it immediately.
- Child data is used solely to personalize milestone box curation and expert guidance timing. It is not used for advertising, sold, or shared beyond what is necessary for service delivery.
- Upon account deletion, all child-related milestone and birth data is deleted along with the account, subject to applicable legal retention requirements.
We're Building Something Special — In Real Time
The Waivy Baby platform is currently in active development and testing. Features may change, break, or disappear. Data may be reset. These are the rules that govern your experience during this phase — and the protections that apply to Waivy Baby while we build.
The Waivy Baby platform — including our curated milestone boxes, expert seminars, concierge messaging, and membership portal — is currently provided in a BETA state. By participating, you acknowledge:
- Bugs & Errors: The services may contain bugs, errors, inaccuracies, and may not operate as intended at all times. This is expected and normal for a Beta phase.
- Features May Change or Disappear: Any feature, function, content, seminar schedule, messaging capability, or product availability may change, break, be removed, or disappear at any time without notice.
- Data May Be Lost: Any data you submit, store, or access during this phase — including sleep logs, feeding notes, messages, uploads, preferences, or profile settings — may be wiped, reset, lost, corrupted, or deleted during testing phases without prior notice. Do not rely on the Beta platform as your primary record of this information.
- No Uptime Guarantees: There are no guarantees of continuous, uninterrupted, timely, or secure access to the platform.
- US Only: The Beta Phase is currently US-only and is not offered to users in the EU/EEA/UK or regions where GDPR or similar requirements apply, unless expressly agreed in writing.
- Must Be 18+: Beta participation requires that you are at least 18 years of age.
To the maximum extent permitted by law, Waivy Baby's total aggregate liability for all Beta-related claims is limited to the amount you paid for Beta access during the applicable period. If Beta access is free, total liability is capped at $0.00 USD.

During the Beta Phase, we collect additional data to improve the platform. This includes:
- Email Address: To support account access, communications, and Beta participation.
- Usage Metrics: How you navigate the portal, clicks/taps, page/screen views, feature usage, time spent, and interactions with content.
- Device Information: Device type, OS version, browser type, app version, language, IP address, and device identifiers.
- Crash & Performance Data: Error logs, crash reports, and performance metrics collected automatically to fix bugs and optimize the platform.
- Third-Party Analytics: Beta usage data may be shared with trusted third-party analytics providers and development tools (including logging, crash reporting, performance monitoring, and product analytics) to fix bugs, understand usage, and optimize performance.
- Your Rights During Beta: You maintain the right to request deletion of your personal data at any time, subject to our standard Data Privacy & Sharing Policy.
- Feedback is Waivy Baby's Property: Any suggestions, feedback, ideas, feature requests, bug reports, testimonials, comments, or other input you provide to Waivy Baby ("Feedback") are the sole and exclusive property of Waivy Baby LLC.
- Irrevocable Assignment: You irrevocably assign to Waivy Baby LLC all right, title, and interest in and to the Feedback. Waivy Baby may use, reproduce, modify, implement, publish, distribute, and commercialize Feedback for any purpose, without compensation or credit to you.
- No Employment or Partnership: Your Beta participation and feedback are voluntary and do not create any employment, contractor, partnership, joint venture, or agency relationship with Waivy Baby.
- No Expectation of Confidentiality: Unless separately agreed in writing, do not submit Feedback that you consider confidential. Feedback is treated as non-confidential and non-proprietary.
- Right to Terminate: Waivy Baby reserves the right to modify, suspend, or terminate the Beta Phase or your individual access to the platform at any time, for any reason or no reason, with or without prior notice.
- Discontinuation: We may discontinue the Beta Phase entirely at our discretion, without prior notice, at which point these Supplemental Beta Terms will be superseded by our General Terms and Conditions.
- Transition: Upon transition from Beta to general availability, updated Terms will be provided. Continued use of the platform after the transition constitutes acceptance of the updated Terms.
- No Right to Continued Access: Beta access does not create any right to continued access, specific features, or any particular service level once the Beta Phase concludes.
